Can I Legally Order Vapes Online? State-by-State Rules
The short answer: yes, in most US states, adults 21+ can legally order vapes online. But state laws differ, and some states—including New York—restrict online sales of vaping products, especially those containing liquid nicotine.
| State | Online Vape Sales | Key Rule |
|---|---|---|
| New York | Restricted | Online sale of vaping products with liquid is prohibited; buy in person from licensed retailers. |
| California | Legal | Adults 21+ can order online; flavored vape sales are banned unless approved. |
| Texas | Legal | Online orders shipped into Texas are legal; in-state sales are regulated. |
| Florida | Legal | Age verification required; no flavored vape ban at state level. |
| Massachusetts | Restricted | Flavored vape ban applies to online and in-store sales. |
| Most Other States | Legal | Federal PACT Act applies; USPS cannot ship vapes, but private carriers can with age checks. |
Always check your state's current laws before ordering. The New York State Department of Health enforces the flavored vape ban and online sales restrictions.

|---|---|---|
| No age verification | Site asks for DOB only, not ID | Legit sellers verify age with government ID. |
| Prices too low | Compare with local dispensary prices | Extreme discounts often mean counterfeit products. |
| No physical address | Look for a real business address | Scam sites hide their location. |
| No lab testing info | Check for third-party lab results | Quality brands publish test results. |

Ordering vapes online can carry legal risks if you break state laws.
